By using Chat Kim-E (chatkime.com) or the Chat Kim-E apps for iPhone and Android, you agree to these terms. If you don't agree, please don't use the service.
The service
Chat Kim-E is a companion chat app in public beta, run by one independent operator. You use it with an individual account: your own email address and password, your own conversations, your own subscription. There are two ways to get a reply — the hosted Cloud Companion, which runs on a third-party model provider and needs a subscription, and the Local Companion, which runs on a model server on your own machine and is free to use.
Beta status
This is a beta, which means three concrete things. Features can change or be withdrawn. Hosted chat can be paused at short notice if a model, billing, privacy, or safety problem is found — when that happens you will see a plain message saying so, and your saved conversations, your data download, and the Local Companion continue to work. And access may be limited (for example, new signups closed for a period) while a problem is investigated.
What the companion is, and is not
Kimi is a language model with a warm, consistent personality. It is not a person, and it will not claim to be one. It is not a therapist, counsellor, doctor, lawyer, accountant, or emergency service, and nothing it says is professional advice of any kind. It has no memory of you beyond what you have chosen to store, no life outside the conversation, and no ability to contact anyone on your behalf.
AI output can be inaccurate, incomplete, out of date, or confidently wrong. Use your own judgment and verify anything that matters.
If you are in danger, or thinking about harming yourself, please contact your local emergency number or a crisis line. Kimi will point you to real help in that situation, but it cannot provide it.
Eligibility
You must be old enough in your country to agree to these terms and to hold an account, and at least 18 if that is the higher figure where you live. Accounts are for individuals; please don't share one.
Subscriptions, payment, and cancellation
- Cloud Companion is a recurring subscription. It is sold and charged by Apple, Google, or the web store, not by Chat Kim-E. Card details never reach this service.
- Prices and billing periods are shown by that store before you buy, in your own currency, and it charges you again each period until you cancel.
- Cancel any time in the same place you subscribed — App Store subscriptions on iPhone, Google Play subscriptions on Android, or the management link in Settings → Account for a web purchase.
- After cancelling, access continues until the end of the period you have already paid for, then stops. The unused part is not refunded unless the store's own refund policy gives you one; refunds are handled by that store, not here.
- Cancelling never deletes your conversations. They stay synced and exportable, and the Local Companion keeps working.
- If a payment fails, stores allow a short grace period. Access continues during it, and Settings will say so plainly rather than cutting you off without explanation.
Fair use
Hosted replies cost the operator money, so each account has a generous daily allowance of replies and tokens, and requests are rate limited. If you reach a limit, the app says which one and when it resets. These limits exist to keep one automated client from spending the beta's budget, not to ration ordinary conversation. Local Companion turns run on your hardware and never count against them.
Acceptable use
Please don't use Chat Kim-E to do anything unlawful; to harass, deceive, or endanger anyone; to generate sexual content involving minors; to attempt to break, overload, scrape, or gain unauthorized access to the service; to resell or automate access to the hosted model; or to generate content that breaks the AI provider's usage policies. Accounts doing these things can be suspended without notice.
Your content
Your conversations are yours. You keep all rights in what you write, and you grant the operator only the narrow permission needed to run the service — to store your conversations, sync them between your devices, and pass them to the model provider so that a reply can be generated. Your conversations are not used for advertising and are not used to train any model.
You are responsible for what you submit and for how you use the replies. Exporting your own backups is one click, and worth doing for anything you would hate to lose.
Your data
You can download everything this service holds for you, or delete your cloud copy, at any time from Settings → Account. To delete your whole account, including your email address, ask and it will be done. See the Privacy Policy for what is stored, for how long, and who else it reaches.
Third-party AI and independence
Hosted responses are generated by a third-party model via Kimi API technology, and web search results come from Brave Search. Chat Kim-E is an independent application and is not affiliated with, sponsored by, or endorsed by Moonshot AI, Kimi, Brave, Apple, or Google.
Availability
The service is provided on a best-effort basis by one person and may be interrupted, changed, paused, or discontinued. If it is going to be discontinued, you will be given notice and time to export your conversations.
Ending your use
You can stop at any time: cancel the subscription in your store, export your data, and delete your cloud data or your account. The operator may suspend or end an account for a breach of these terms, or if required to; where it is possible to do so, you will be told why and given a chance to export first.
No warranty
Chat Kim-E is provided "as is" and "as available", without warranties of any kind, express or implied, to the extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, the operator of Chat Kim-E is not liable for any indirect, incidental, or consequential damages, or for loss of data, arising from your use of the service. Nothing here limits any right you have under consumer law that cannot be limited.
Changes
These terms may be updated; the "Last updated" date above reflects the current version. A material change will be announced in the app before it takes effect, and continued use after that means you accept the updated terms.
